HEALTHCARE BPJS INDONESIA: CHALLENGES AND CHANCES TO PROVIDE RIGHT TO HEALTH FOR ALL INDONESIANS

Abstract

According to Indonesian Constitution, the Government guarantees the Indonesian citizens to have health services and obliges the Government to establish a policy system as the implementation of the Nationally Social Security Program in the form of Healthcare. Healthcare is managed by the Social Security Administering Agency which is mandatory for all Indonesians and foreigners who have been living for at least 6 months in Indonesia. The purpose of Healthcare is the Indonesia Government provides protection for the basic requirements of burdensome people. Healthcare participants include Beneficiaries of Contribution and Non Beneficiary of Contribution . However, it is possible that a dispute occured between the agency and the participants. The aim of this research is to investigate Health Insurance System in Indonesia and to find solutions if there are health insurance participants who do not get their rights. The dispute settlement may be resolved by non litigation and litigation.
