Abstract

Compensation is an appropriate and fair compensation to those who are entitled to the land acquisition process. This has already been explained in the Land Acquisition Law. The purpose of this study is first to analyze and understand what the legal consequences are for Article 81 paragraph (1) Jo Article 74 paragraph (1) letter e concerning Benchmarks for Non-Physical Compensation of Land Procurement for Public Interest, secondly to analyze and find solutions to Juridical Problems Article 81 paragraph (1) Jo Article 74 paragraph (1) letter e Related to Benchmarks for Non-Physical Compensation for Land Procurement for Public Interest. Normative juridical research methods, using statutory approach and conceptual approach. The conclusion is that there is a blurring of the concept of people's prosperity in Article 81 paragraph (1) Jo Article 74 paragraph (1) letter e Related to Benchmarks for Non-Physical Compensation of Land Procurement for Public Interest Theoretically, non-physical compensation in addition to compensation may be in the form of payment of special value, payment of the value of potential loss and/or payment of the obligation experienced by the holder of land rights. Compensation to be given to the subject of rights by the government that requires land must be measured in detail, clearly and decisively qualitatively method.
