THE SYNCHRONIZATION OF BALI LOCAL GENIUS VALUE AND THE STATE LEGAL VALUE

Abstract

Indonesia had already chosen a specific philosophy namely Pancasila. The consequences of this option was all the values embodied in the lower level the constitution shuld not be contradict with the value of the constitution due to the constitution as the basic norm/fundamental norm but even more as the cristalization of meta-values of Pancasila as legal philosophy of Indonesia legal system. The problem then arise: wether or not the local genius value of customary rules of Balinese communities compatible with the values of the state law which its values derived from the Pancasila. To analyse the problem, the author need to conduct such a research, this research conform to the normative legal research with primarily and secondairy legal materials such as several text-books and documents. The results of the research shown that insome aspects there were parallelization between the constitutional values and the local customary values, but on the other hand still there were contradicted values in many aspects.
