GENDER BIASED ON LAW ENFORCEMENT FOR THE SETTLEMENT OF CRIMINAL VIOLENCE ON WIFE BASED ON THE LAW NUMBER 23 YEAR 2004

Abstract

Law enforcement apparatus, such as police, prosecutors, judges, can be seen from various judges' decision in the case of violence against wife, still being gender biased. The victim has doubts, concerns and fears about reporting the incident, for the legal process that will be faced because of the ignorance of the victim in the procedure that should be taken. Awareness and gender sensitivity of law enforcers are still lacking, sometimes the victims even become the object. Violence against the wife is considered as a private matter because it will eventually finish by itself. Ideally, rape cases are sometimes directed at "loving each other" acts, or avictims blamed for dressing up or "attracting" attention. The police as law enforcement officers should be the pillars who support the construction of law for the upholding of justice for women victims of violence. The apparatus must have gender sensitivity to protect KDRT victims.
