Defect Occurrence Pattern of Wood Work in Apartment Building

Abstract

Disputes due to the defect occurred on the apartment become more and more serious in Korea. However, the case expanded as lawsuit cannot be agreed peacefully due to sharp difference in position between the parties to a dispute is increased rapidly. The term of defect warranty liability which is one of legal standard related with these defects is settled as maximum 10 years for the reliability to defect repair and make sure to protect the person holding a partitioned ownership. However, the term of defect warranty liability faced a criticism that it is unrealistic because it is not classified properly to apply the law as well as the set-up basis for the system itself is not existed. So, I performed the review that current term of defect warranty liability is proper level for the improvement and settlement of the term of defect warranty liability system. I have checked that how many defects have been occurred actually on wood work among various works related with apartment and the defects occurred in a year shows which patterns and the result is as follows. Firstly, defect occurrence of wood work is the most until the first year since the completion of the construction and very small after three years. Also, the time exceeding 95% of cumulative rate of occurred defects is after three years since the completion of the construction Secondly, defect occurrence pattern for total wood work and structure, surface material work and wood interior excluding wood work are seen as almost same. So, I think it is desirable to unify the term of defect warranty liability of wood work and detailed works. Thirdly, there is significant difference between the terms of defect warranty liability for wood work in current registration as one or two years and the time exceeding 95% of cumulative rate of occurred defects represents actual defect occurrence pattern is three years. There should be more in-depth study for the reason of this difference and the factor to influence on it should be implemented.
