Legal Formulation Policy of Environmental Damage as the State Financial Loss in Indonesia

Abstract

This legal study employed economic valuation approach to study, to analyze, and to formulate legal policy of environmental damage as the state financial loss in Indonesia. Environmental pollution and/or damage are a crucial issue in legal area in relation to the effectiveness of Law Number 32 of 2009 about Living Environment Protection and Management. Indonesia has Minister’s Regulation Number 7 of 2014 about Living Environmental Loss due to Living Environment Pollution and/or Damage, serving as the executing regulation of Law Number 32 of 2009. However, such the legislation has not governed concretely yet the environmental damage as the state financial loss. Legal attempt using economic valuation approach was then formulated as an ideal policy model of legal formulation for environmental damage as the state financial loss as the restorative attempt to restore Indonesian environment.
