THE REGIONAL REGULATION CONCERNING MANAGEMENT OF ZAKAT VIEWED FROM THE PRINCIPLES OF FORMULATION OF LEGISLATION

Abstract

The formulation of regional regulation is a manifestation of the authority devolved to the regional government in the context of implementing autonomy to carry out rights and obligations. In its formulation, a set of principles of legislation has been formulated as a means of control over regional authority. Although in practice, this principle is often ignored by regulatory organ such as the Asahan District Regulation on the Management of Zakat. The main problem in this study namely the implementation of the principle of formulation of legislation in formulating the Asahan District Regional Regulation on Management of Zakat. The data collection process used by the researchers namely the normative juridical approach. The result showed that the Asahan District Regulation concerning the management of Zakat in its formulation process ignored the principle of the formulation of legislation. So it can be concluded that the formulation process is not appropriate as it should be.
